SizeKit – Terms & Conditions

1. Subscription Plan

Early Adopter Annual Plan

By purchasing an Early Adopter subscription, you are purchasing early access to SizeKit at $139 billed annually.

• Payment: You will be charged $139 at the time of purchase.
• Access: You will receive access to SizeKit within 24 hours of purchase via an email invitation or access link.
• Pricing: Early Adopter pricing is limited and may change for future subscribers.

2. No Refund Policy

Once access to SizeKit has been granted and you begin using the service, all sales are final and non-refundable.

By subscribing, you acknowledge that:

• You are purchasing access to a digital software service.
• You waive any right to a refund once access is provided.
• Refunds are only available if access has not yet been granted.

3. Service Availability

• We aim to provide access within 24 hours of purchase.
• SizeKit is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted service, uptime, or error-free operation.
• We reserve the right to modify, suspend, or temporarily discontinue the service for maintenance, improvements, or technical reasons.

4. Acceptable Use, Competitive Access & Reverse Engineering Prohibition

You agree that you will not access or purchase SizeKit for the purpose of evaluating, copying, reverse engineering, benchmarking, competing with, or building a similar product or service.

By subscribing, you affirm that you are not a direct competitor of SizeKit and are not acting on behalf of one.

You may not:

• Reverse engineer, decompile, disassemble, or attempt to derive source code, models, algorithms, workflows, or system logic.
• Use SizeKit to develop, train, benchmark, or validate competing software, services, or technologies.
• Copy, scrape, record, reproduce, or systematically analyze outputs, interfaces, or behavior for competitive purposes.
• Purchase or access SizeKit with intent to create a competing product.
• Share credentials or grant unauthorized access.
• Circumvent technical protections or access controls.

Any violation of this section may result in immediate termination without refund and may subject you to legal action.

5. Intellectual Property

All software, models, interfaces, designs, workflows, content, and underlying technology remain the exclusive property of ZIGGYCOW LLC.

You are granted a limited, non-exclusive, non-transferable license to use SizeKit for your internal business purposes only.

No ownership rights are transferred.

6. Data Usage

By using SizeKit, you grant us permission to collect, store, process, and use data and content you submit through the service for the purposes of:

• Operating and providing the service
• Improving product performance and accuracy
• Developing, training, and refining models and features
• Customer support, analytics, and quality assurance

We do not sell your personal data to third parties.

7. Limitation of Liability

To the maximum extent permitted by law, ZIGGYCOW LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Lost revenue
• Incorrect sizing outcomes
• Business interruption

Our total liability shall not exceed the amount paid by you in the previous twelve (12) months.

8. Changes to Service and Pricing

• We may modify, suspend, or discontinue SizeKit at any time.
• If we permanently discontinue the service, we will provide a prorated refund for unused time.
• Pricing may change for new subscribers at any time.

9. Account Responsibility

You are responsible for all activity under your account and for maintaining the confidentiality of your credentials.

10. Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.
